Homeowner Terms of Service

Washington Home Contractors is a contractor referral and project matching service. All construction services are provided by independent licensed contractors. Washington Home Contractors does not perform construction work.

These Terms of Service ('Terms') govern your use of the Washington Home Contractors website and lead submission services ('Service'). By submitting a project request you agree to be bound by these Terms.

1. Referral Service Disclosure

Washington Home Contractors is a lead generation, referral, project qualification, and contractor matching service. We are NOT a general contractor, construction company, subcontractor, or supplier. We do not perform, supervise, manage, or direct construction work of any kind.

2. Independent Contractor Disclosure

Any contractor you are matched with is an independent business, not an employee, partner, agent, joint venturer, or representative of Washington Home Contractors. All estimates, proposals, pricing, schedules, materials, workmanship, permits, code compliance, safety, insurance, and warranties are the sole responsibility of the contractor you choose to engage. You will contract directly with that contractor, not with Washington Home Contractors.

3. No Guarantee of Contractor Performance

While we screen contractors prior to inclusion in our network (license, bond, insurance, and reputation review), we make no representation, warranty, or guarantee — express or implied — regarding any contractor's quality of work, pricing, timeliness, conduct, financial stability, or fitness for your project.

4. No Warranty on Contractor Work

All workmanship, materials, and project warranties are provided (or not provided) solely by the independent contractor performing the work. Washington Home Contractors disclaims any and all warranties, express or implied, regarding construction services, including merchantability and fitness for a particular purpose.

5. Homeowner Responsibility

You are solely responsible for reviewing each contractor's license, bond, insurance, references, written bids, contracts, change orders, permits, lien rights notices, and any other documentation before signing a contract or making payment. We strongly encourage you to obtain multiple bids and to read all documents carefully.

6. Consent to Be Contacted

By submitting a project request you expressly consent to be contacted by Washington Home Contractors and by matched contractors at the phone number, text number, and email address you provide, including by autodialer or prerecorded message, for the purpose of discussing your project. Standard message and data rates may apply. Consent is not a condition of any purchase. You may opt out at any time by replying STOP to texts or unsubscribing from emails.

7. Permission to Share Project Information

You authorize Washington Home Contractors to share the information you submit (name, contact details, project scope, location, budget, timeline, and any notes) with one or more independent contractors in our network for the purpose of evaluating and responding to your project.

8. Limitation of Liability

To the maximum extent permitted by law, Washington Home Contractors and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to (a) any contractor's acts or omissions, (b) any contract you enter with a contractor, or (c) your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed one hundred U.S. dollars ($100.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless Washington Home Contractors from any claim or demand made by any third party (including any contractor) arising out of your project, your contract with any contractor, or your breach of these Terms.

10. Dispute Resolution

Any dispute relating to the Service shall first be addressed through good-faith informal negotiation. If unresolved within thirty (30) days, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Snohomish County, Washington. Each party waives the right to a jury trial and to participate in any class action.

11. Governing Law & Venue

This Agreement is governed by the laws of the State of Washington, without regard to its conflict of laws provisions. The exclusive venue for any dispute shall be the state or federal courts located in Snohomish County, Washington.

12. Changes to These Terms

We may update these Terms from time to time. The current version is identified at the top of this page. Continued use of the Service after an update constitutes acceptance of the revised Terms.
